Judges uphold possibility for gays to register as NGOs

As of today Kenya may like General Vannacci and his fans a little less.
While the law that punishes so-called "unnatural offenses," i.e., "having carnal knowledge with any man, woman or animal against the order of nature," remains in effect, the Supreme Court in Nairobi has upheld the right of nongovernmental associations that promote the rights of LGBTQ+ communities to meet and register as NGOs.

In fact, the judges rejected an appeal filed by Homa Bay MP Peter Opondo Kaluma, who had challenged the same court's decision, issued last February, which effectively overturned a ruling by the National Coordination of NGOs that did not grant the National Gay and Lesbian Human Right Commission (Nglhrc) the right to be formally recognized as such, which was accused of "promoting homosexual behavior." The judges' decision, with three in favor and two against, had effectively ended a decade of battles by Lgbtqia+ groups, and was seen as a first step toward the recognition of their rights in a country that still criminalizes their sexual orientations. The court, however, stressed that all people, whether heterosexual, lesbian, gay, intersex or otherwise, will be subject to penalties if they contravene existing laws, including Sections 162, 163 and 165 of the Penal Code.

Long therefore is still the road to complete freedom for homosexuals. But in other African countries, Uganda for example, the situation is even more difficult for them. In fact, the government in Kampala even provides for life imprisonment for those who engage in non-heterosexual attitudes in public. For this reason, the U.S. government has repeatedly threatened to end all diplomatic and trade relations with the current administration of President Yoweri Museveni, who, in response, has stated that he does not accept impositions from the Western world. Kenyan leader William Ruto, like his predecessor Uhuru Kenyatta, albeit with slightly less "fundamentalist" positions, also seems to follow the same line.
